What is Probate?

Probate is the legal process of administering a person's estate after they have died. This may involve obtaining a Grant of Probate or Letters of Administration, collecting assets, paying debts and taxes, and distributing the estate to the beneficiaries.

How long does Probate take?

Every estate is different. Straightforward estates may be completed within several months, whilst more complex estates involving property sales, tax issues or disputes can take considerably longer. During our initial meeting, we can provide an indication of the likely timescale for your circumstances.

Do all estates require Probate?

No. Whether Probate is required depends on the type and value of the assets involved. Some estates can be administered without a Grant, while others require one before banks, investment providers or the Land Registry will release assets.

Can I instruct a solicitor to deal with the entire estate?

Yes. We can provide as much or as little assistance as you require. Some clients ask us to obtain the Grant of Probate only, whilst others prefer us to handle the entire administration from start to finish, providing support throughout the process.
